A. Right of Withdrawal Policy

Introduction

Consumers are entitled to a right of withdrawal under the following conditions, where a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity:

Right of Withdrawal for EU Customers

If you are a customer residing in the European Union, you have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last item.

To exercise your right of withdrawal, you must inform us (EMS Yachting GmbH, Bernstorffstraße 139, 22767 Hamburg, Germany, Tel.: +49 (0) 40 317 953 94, Email: shop@emsyachting.com) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, excluding packaging and shipping costs, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction, unless otherwise expressly agreed; you will not incur any fees for this refund.

We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send back the goods before the fourteen-day period has expired.

You are responsible for the return shipping costs. If the goods cannot be returned by regular post (e.g. freight items), estimated return costs may be up to 600 EUR per item. We will refund delivery costs up to the amount of the cheapest available shipping method at the time of order.

You are only liable for any diminished value of the goods if this loss in value is due to handling that is not necessary for checking the condition, properties and functionality of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are made to the consumer’s specifications or clearly personalized.

The right of withdrawal also expires prematurely for goods that, by reason of their nature, have been inseparably mixed with other goods after delivery.

Furthermore, the right of withdrawal does not apply to consumers who, at the time of the conclusion of the contract, do not belong to a member state of the European Union and whose sole place of residence and delivery address are outside the European Union.

Additional Conditions for Returns

• Original Packaging: Please return items in the original packaging if possible. If not available, ensure safe transport packaging.
• Unused Condition: Goods must be returned in unused condition. Visible signs of use may result in a reduction of the refund.
• Damage or wear: Items with visible damage from use are not eligible for return or refund.
• No freight collect: Freight collect returns will not be accepted.
